The McKinney-Vento Homeless Education Assistance Act was established in 1987 to assist homeless children and youth with enrolling, attending and succeeding in school. Under this legislation, homeless youth are guaranteed the same educational services that all students are provided in order to meet challenging academic standards. The Act also ensures that homeless youth remain in their school of origin when feasible, or attend the school identified by the attendance zone in which the student is currently physically staying. El Acta de Asistencia Educativa para niños sin hogar y McKinney-Vento se estableció en 1987 para ayudar a los jóvenes sin hogar a matricularse, a asistir y tener éxito en la escuela. Bajo esta ley, los adolescentes sin hogar son garantizados los mismos servicios educativos que se le proporcionan a todos los estudiantes para alcanzar los perfiles académicos competentes. Esta ley también asegura que los jóvenes permanezcan en su escuela de origen, cuando sea factible, o asistir a la escuela identificada por la zona de asistencia en la cual el estudiante reside físicamente.  Para más información sobre el Acta McKinney-Vento, por favor visite: El Centro Nacional Educativo para niños sin hogar The National Center for Homeless Education  o La Asociación Nacional Educativa para niños sin hogar.

The McKinney Vento Act defines "homeless youth" as:

Youth who lack a fixed, regular and adequate night time residence.

This may include students who are:

• Temporarily staying with a friend, relative or someone else due to loss of housing (including foreclosure, loss of income, or financial hardship)
• Living in emergency shelter, domestic violence shelter or transitional shelter
• In CPS custody, awaiting foster placement (ie. group home placement)
• Living in hotels, motels, campground, parks, cars, abandoned buildings, bus/train, or similiar enviroments
• "unaccompanied youths" or students who are on their own and not in the physical custody of a parent or legal guardian

El Acta McKinney-Vento define a jovenes "sin hogar" como:

Jovenes sin una residencia fija, regular, y adequada. 

Esto puede incluir a los estudiantes que:

• Se estan quedadndo temporalmente con amigos, parientes o alguien mas debido a la perdide de vivienda (incluyendo hipoteca), ingresos, o dificultades financieras
• Viviendo en refugios de emergencia, refugios de violencia domestica o refugios de transicion
• En la custodia de CPS (Servicios de proteccion infantil); en espera de coleccion en un hogar de guarda (ie. colocacion en hugar de grupo)
• Viviendo en hotel, motel, acampada, auto, parquet, edificio abandonado, estacion de bus/tren o ambiente similar.
• Un "joven no acompañado" o estudiante que estan por su cuenta y no en la custodia fisica de un padre o tutor legal
